Sleep Arcade & Sleepy Pal – Terms of Service

Welcome to Sleepy Pal / Sleep Arcade (“we,” “our,” or “the App”). By downloading or using the App, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App. These Terms supplement the Apple LICENSED APPLICATION END USER LICENSE AGREEMENT (EULA) that automatically applies to the App. Use of the App constitutes agreement to both Apple’s EULA and these Terms of Service. These Terms supplement, and are in addition to, the Apple End User License Agreement, and do not modify or limit any rights or obligations under Apple’s EULA
1. Eligibility
The App is intended for users aged 13 and older. This is because user data such as email is requested, which is not allowed for users under 13 per COPPA. Users under 13 should not use the App. By using the App, you confirm that you meet this age requirement.
2. Use of the App
You may use the App for personal, non-commercial purposes only.
You may not use the App for illegal or unauthorized purposes.
The App is for relaxation, and entertainment purposes only. It is not a medical device or app and does not provide medical advice, diagnosis, or treatment. It is not intended to treat any medical condition, sleep disorder, or mental health condition. It should not be relied upon as a substitute for professional medical care. Always consult a qualified healthcare provider if you have any health concerns, sleep disorders, or other medical conditions.
Use of the App is at your own risk, and by using it, you acknowledge that the App, it’s developers, and owners (Fais Dodo Code-o Dojo LLC) are not responsible for any health-related consequences.
You assume full responsibility for any effects or consequences from your use of the App.
3. Account and Sign in with Apple
The App may allow you to log in using Sign in with Apple. Apple manages the consent process for sharing your email. Users may choose to hide their real email using Apple’s Private Relay.
You are responsible for keeping your account credentials secure.
4. In-App Purchases
The App may offer in-app purchases or subscriptions through Apple’s App Store. Payments are processed exclusively by Apple; we do not store your payment information.
All sales are final, except as required by law or Apple’s policies.
5. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, users consent to the data collection practices described in the Privacy Policy.
6. Intellectual Property
All content, trademarks, logos, and software in the App are owned by Fais Dodo Code-o Dojo LLC or its licensors. You may not copy, modify, distribute, or create derivative works without our permission.
7. Limitation of Liability
To the fullest extent allowed by law, the App is provided “as is” and “as available.” We are not responsible for damages related to health-related consequences, loss of data, profits, or use, arising from your use of the App. Additionally, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
In no event will our total liability exceed $50 USD or the amount you paid for use of the app, whichever is greater.
8. Termination
We may suspend or terminate your access to the App at any time for violations of these Terms or as allowed by law. When your access is terminated, your right to use the App ends immediately.
9. Changes to Terms
We may update these Terms from time to time. Continuing to use the App after changes means you accept the updated Terms. Please review them periodically.
10. Governing Law
These Terms are governed by the laws of the United States and the state where the app owner is located, without regard to conflict of law rules. Any disputes arising from these terms or your use of the app shall be resolved exclusively in the courts of Orleans Parish, LA.

11. Acceptance of Terms
By downloading, installing, or using Sleepy Pal / Sleep Arcade (the “App”), you acknowledge that you have read, understood, and agree to these Terms of Service and our Privacy Policy. Your continued use of the App constitutes your acceptance of and agreement to be bound by these Terms, even if you do not actively click an “I Agree” button.
