Sleep Arcade & Sleepy Pal – Terms of Service FOR IOS/APPLE USERS

Welcome to Sleepy Pal / Sleep Arcade (“we,” “our,” or “the App”). By downloading or using the App, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App. These Terms supplement the Apple LICENSED APPLICATION END USER LICENSE AGREEMENT (EULA) that automatically applies to the App. Use of the App constitutes agreement to both Apple’s EULA and these Terms of Service. These Terms supplement, and are in addition to, the Apple End User License Agreement, and do not modify or limit any rights or obligations under Apple’s EULA

1. Eligibility

The App is intended for users aged 13 and older. This is because user data such as email is requested, which is not allowed for users under 13 per COPPA. Users under 13 should not use the App. By using the App, you confirm that you meet this age requirement.

2. Use of the App

You may use the App for personal, non-commercial purposes only.
You may not use the App for illegal or unauthorized purposes.
The App is for relaxation, and entertainment purposes only. It is not a medical device or app and does not provide medical advice, diagnosis, or treatment. It is not intended to treat any medical condition, sleep disorder, or mental health condition. It should not be relied upon as a substitute for professional medical care. Always consult a qualified healthcare provider if you have any health concerns, sleep disorders, or other medical conditions.
Use of the App is at your own risk, and by using it, you acknowledge that the App, it’s developers, and owners (Fais Dodo Code-o Dojo LLC) are not responsible for any health-related consequences.
You assume full responsibility for any effects or consequences from your use of the App.

3. Account and Sign in with Apple

The App may allow you to log in using Sign in with Apple. Apple manages the consent process for sharing your email. Users may choose to hide their real email using Apple’s Private Relay.
You are responsible for keeping your account credentials secure.

4. In-App Purchases

The App may offer in-app purchases or subscriptions through Apple’s App Store. Payments are processed exclusively by Apple; we do not store your payment information.
All sales are final, except as required by law or Apple’s policies.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, users consent to the data collection practices described in the Privacy Policy.

6. Intellectual Property

All content, trademarks, logos, and software in the App are owned by Fais Dodo Code-o Dojo LLC or its licensors. You may not copy, modify, distribute, or create derivative works without our permission.

7. Limitation of Liability

To the fullest extent allowed by law, the App is provided “as is” and “as available.” We are not responsible for damages related to health-related consequences, loss of data, profits, or use, arising from your use of the App. Additionally, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

In no event will our total liability exceed $50 USD or the amount you paid for use of the app, whichever is greater.

8. Termination

We may suspend or terminate your access to the App at any time for violations of these Terms or as allowed by law. When your access is terminated, your right to use the App ends immediately.

9. Changes to Terms

We may update these Terms from time to time. Continuing to use the App after changes means you accept the updated Terms. Please review them periodically.

10. Governing Law

These Terms are governed by the laws of the United States and the state where the app owner is located, without regard to conflict of law rules. Any disputes arising from these terms or your use of the app shall be resolved exclusively in the courts of Orleans Parish, LA.

11. Acceptance of Terms

By downloading, installing, or using Sleepy Pal / Sleep Arcade (the “App”), you acknowledge that you have read, understood, and agree to these Terms of Service and our Privacy Policy. Your continued use of the App constitutes your acceptance of and agreement to be bound by these Terms, even if you do not actively click an “I Agree” button.

Welcome to Sleepy Pal / Sleep Arcade (“we,” “our,” or “the App”). By downloading, installing, or using the App, you agree to these Terms of Service / End User License Agreement (“Terms” or “EULA”). If you do not agree, do not use the App. Your continued use constitutes acceptance of these Terms.

1. License Grant

The App is licensed, not sold, to you. We grant you a non-transferable, non-exclusive license to use the App on devices you own or control in accordance with these Terms and the Usage Rules in this agreement. You may not:

Distribute, resell, sublicense, rent, or make the App available over a network for multiple users simultaneously.
Copy, reverse-engineer, decompile, disassemble, attempt to derive the source code, or create derivative works, except as permitted by law.
Remove or alter any proprietary notices in the App.

All rights not expressly granted are reserved by Fais Dodo Code-o Dojo LLC or its licensors.

4. Account and Sign In

The App may allow login using Sign in with Google. Google manages the consent process for sharing your email. Users may choose to hide their real email using Google’s masking options.
You are responsible for keeping your account credentials secure.

5. In-App Purchases

The App may offer in-app purchases or subscriptions via Google Play. All payments are processed exclusively through Google; we do not collect or store payment information.
All sales are final, except as required by law or Google’s policies.

6. Privacy and Data Collection

Your use of the App is governed by our Privacy Policy, which explains what data we collect, how it is used, and your rights.
By using the App, you consent to the collection and use of data as described in the Privacy Policy.
Data may include account information, usage statistics, device info, and analytics collected via Google or Firebase.

8. Restrictions and Export Compliance

You may not use or export the App in violation of applicable laws, including U.S. export laws.
You represent that you are not located in embargoed countries or on U.S. restricted lists.

10. Termination

11. Disclaimers and No Warranty

The App is provided “as is” and “as available”.
We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
Use of the App is at your own risk. We are not responsible for health-related consequences or any loss, damage, or inconvenience resulting from use of the App.
No method of transmission or storage is completely secure; we cannot guarantee absolute security.

12. Limitation of Liability

13. App Updates & Changes to Terms

We may update these Terms from time to time. Continued use of the App constitutes acceptance of the updated Terms.

We may provide updates, patches or new versions of the app. These updates may automatically install or require your approval. Updates are governed by these same terms unless additional terms accompany them.

We may modify, suspend, or discontinue parts or all of the App at any time without notice or liability.

14. Governing Law

These Terms are governed by the laws of the United States and the State of Louisiana without regard to conflicts of law. Any disputes shall be resolved in the courts of Orleans Parish, LA, unless otherwise required by local law.
